Welcome to Aurea Sterling

These Terms of Service ("Terms") govern your use of aureasterling.com (the "Site") and any purchase you make from us. By browsing, registering, or buying from Aurea Sterling, you agree to be bound by these Terms. If you don't agree with any part, please don't use the Site.

We've written these Terms in clear language wherever possible. The legal sections are necessarily formal — they protect both you and us, and they apply in full.


 

1. About us

The Site is owned and operated by Aurea Gold and Diamonds LLP ("Aurea Sterling", "we", "us", "our") — a Limited Liability Partnership registered under the laws of India, with its registered office in Surat, Gujarat, India.

2. Eligibility to purchase

By placing an order, you confirm that:

• You are at least 18 (eighteen) years of age and legally capable of entering into a binding contract under the Indian Contract Act, 1872.
• The information you provide (name, address, contact, payment) is true, accurate, and current.
• You are purchasing for personal use or genuine gifting, unless you have written authorisation from us for resale or bulk purchase.

We reserve the right to refuse service, terminate accounts, or cancel orders if these conditions are not met.


 

3. Products & descriptions

3.1 Materials and craftsmanship

All Aurea Sterling jewellery is made from:

• 925 Sterling Silver — composed of 92.5% pure silver and 7.5% alloy metal (typically copper) for durability. All silver jewellery is BIS Hallmarked where applicable.
• 18K Gold Vermeil — sterling silver base (92.5% pure silver) plated with a thick layer of 18K (75% pure) gold using electroplating. Our vermeil meets industry standards for plating thickness.

3.2 Skin-friendly composition

Our jewellery is nickel-free, hypoallergenic, and crafted to be skin-safe for the vast majority of wearers. We do not use lead, cadmium, or other harmful heavy metals.

However, individual skin reactions can occur due to personal sensitivities, sweat chemistry, prolonged contact with cosmetics/perfumes/chlorinated water, or pre-existing skin conditions. Aurea Sterling does not warrant that any product is suitable for every individual or will not cause a reaction in persons with specific allergies or sensitivities. If you have known metal sensitivities (especially to copper or trace alloys), please consult a dermatologist before purchase.

3.3 Product appearance

We make every effort to display our products accurately on the Site. However:

• Colours, tones, and reflective qualities may appear differently on different screens and under different lighting conditions.
• Handcrafted pieces may show minor variations in finish, polish, or stone placement — these are inherent to artisan-made jewellery and are not defects.
• Natural and lab-created gemstones vary slightly in colour, clarity, and inclusions; the image shown is representative.
• Sizes, weights, and measurements listed on product pages are approximate and may vary by ±5%.

3.4 Product care

Sterling silver and gold vermeil are precious materials that require care. We provide a care guide with every order. Damage caused by improper care, exposure to harsh chemicals, perfumes, sweat, swimming pools, saltwater, or rough handling is not covered under any warranty or buyback policy.


 

4. Pricing & errors

4.1 Pricing

All prices on the Site are displayed in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise. Prices can change at any time without prior notice. The price applicable to your order is the price displayed at the time you complete checkout.

4.2 Pricing errors

In rare cases, products may be listed with incorrect pricing due to system errors, manual data entry mistakes, or promotional misconfiguration. We reserve the right to:

• Cancel any order placed at an incorrect price (whether or not payment has been processed)
• Refund the order in full
• Notify you and offer to reprocess the order at the correct price

We will exercise this right reasonably and notify you within 48 hours of order placement.


 

5. Orders & acceptance

5.1 Order acceptance

Placing an order on the Site is an offer to purchase, not a confirmed contract. Your order is only accepted by us when:

• Payment has been successfully received (for prepaid orders), or
• The order has been verified and confirmed (for COD orders), and
• We send you a dispatch confirmation email or SMS

Until that point, we may cancel, modify, or refuse the order in our sole discretion. Reasons may include:

• Suspected fraud or unauthorised payment
• Unverifiable customer information
• Repeated COD refusal history on the same number/address
• Pricing or stock errors
• Suspected bulk/reseller activity (see Section 6)
• Inability to ship to your location

5.2 Order cancellation by you

• Prepaid orders: Can be cancelled before dispatch by contacting care@aureasterling.com or +91 9998496004. Refunds will be processed per our Refund Policy.
• COD orders: Can be cancelled before dispatch at no cost. Repeated cancellations or refusals after dispatch may result in your number/address being blocked from future COD orders.
• Once dispatched: Cancellation is not possible. You may refuse delivery, but shipping and reverse logistics charges may be deducted from any refund.

 

6. Quantity limits & resale

We sell to end consumers and genuine gifting buyers only. Aurea Sterling products are not authorised for resale by any third party, including online marketplaces (Amazon, Flipkart, Meesho, Myntra), social commerce platforms, or physical retail outlets, unless a written distribution agreement is in place with us.

We reserve the right, at our sole discretion, to:

• Limit or cancel quantities purchased per person, per household, per order, per payment method, or per shipping address
• Refuse, cancel, or hold for verification any order that, in our judgment, appears to be placed by dealers, resellers, distributors, or for non-personal use
• Apply these restrictions to orders placed under the same customer account, same payment instrument, same email, same phone number, or same billing/shipping address

Customers interested in genuine bulk purchase (weddings, corporate gifting, events) are encouraged to contact us directly at care@aureasterling.com for a custom quote and dedicated service.


 

7. Payments

We accept the following payment methods:

• Credit and debit cards (Visa, Mastercard, RuPay, American Express)
• UPI (PhonePe, Google Pay, Paytm, BHIM, and others)
• Net banking
• Wallets (as supported by our payment gateway)
• EMI on eligible cards
• Cash on Delivery (COD) — subject to availability by pincode and order value

All payments are processed by PCI-DSS compliant payment gateways including Razorpay, Shopify Payments, Cashfree, and others. We do not store your card or banking credentials. See our Privacy Policy for details.

Payment failures, refunds, and chargebacks are governed by the policies of the respective payment processor. If a payment is debited but the order is not confirmed, the amount is typically auto-refunded by the gateway within 5–7 business days.


 

8. Shipping, delivery & returns

Shipping timelines, costs, return windows, and exchange terms are governed by our:

• Warranty Policy (link in footer)
• Exchange Policy (link in footer)

These policies form an integral part of these Terms. By placing an order, you agree to be bound by them.


 

9. Promotions, discount codes & gift cards

• Discount codes are valid for a limited period and may have minimum order value, product category, or one-use-per-customer restrictions.
• Discount codes cannot be combined unless explicitly stated.
• Discount codes have no cash value, are non-transferable, and cannot be reissued if expired or lost.
• We reserve the right to cancel or void discount codes used in violation of these Terms or in cases of suspected abuse.
• Gift cards (if and when offered) are governed by additional terms displayed on the gift card purchase page.

 

10. Intellectual property

All content on the Site — including but not limited to product designs, photographs, videos, illustrations, copy, logos, the "Aurea Sterling" name and trademarks, the "AUREA" parent brand, typography, layout, and overall look-and-feel — is the exclusive intellectual property of Aurea Gold and Diamonds LLP or its licensors, and is protected under Indian and international intellectual property laws.

You may not:

• Copy, reproduce, modify, distribute, transmit, display, perform, publish, license, create derivative works from, transfer, or sell any content from the Site without our prior written consent.
• Use any Aurea Sterling content, image, video, or design for commercial purposes, including resale listings on third-party marketplaces.
• Reverse-engineer or replicate our jewellery designs for manufacture, sale, or distribution.
• Use our trademarks, brand name, or logos in any manner that could cause confusion or imply endorsement without our prior written consent.

Unauthorised use will be prosecuted to the fullest extent of the law, including injunctive relief and damages.


 

11. User-generated content (reviews, photos, comments)

When you submit a review, rating, photo, video, comment, or any other content ("User Content") on the Site, on our social media pages, or via tagged posts:

• You grant Aurea Sterling a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, sublicensable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with our business — including on the Site, in marketing materials, on social media, in advertisements, and in any other media now known or later developed.
• You confirm that the content is your original work, does not infringe any third-party rights, and is not defamatory, obscene, misleading, or unlawful.
• You waive any moral rights in the content to the maximum extent permitted by law.

We reserve the right to remove, edit, or refuse to publish any User Content at our discretion, without notice.


 

12. Acceptable use

You agree NOT to use the Site:

• For any unlawful purpose
• To violate any applicable Indian or international laws or regulations
• To infringe any intellectual property rights of ours or others
• To upload, transmit, or distribute viruses, malware, or harmful code
• To harass, abuse, threaten, defame, or impersonate any person
• To scrape, crawl, or systematically download Site content without permission
• To submit false, misleading, or fraudulent information
• To attempt unauthorised access to any portion of the Site, its systems, or other users' accounts
• To interfere with the security, integrity, or performance of the Site
• To use the Site in any way that could disable, overburden, or impair its functionality

We reserve the right to suspend or terminate your access for any violation, and to pursue legal remedies.


 

13. Disclaimer of warranties

To the maximum extent permitted by applicable law:

The Site, its content, and all products and services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. Aurea Sterling does not warrant that:

• The Site will be uninterrupted, secure, error-free, or free of viruses
• Defects will be corrected
• Results obtained from using the Site or products will meet your expectations
• Any product will be fit for any particular purpose other than as ordinarily intended (i.e., as decorative jewellery)

Specifically regarding our products: While we craft our jewellery to be hypoallergenic, nickel-free, and skin-safe, we make no warranty of merchantability, fitness for a particular purpose, or non-allergenicity for any specific individual. Individual skin reactions, tarnishing rates, plating wear, and durability outcomes may vary based on usage, care, body chemistry, environmental conditions, and other factors outside our control.

This disclaimer does not limit any non-excludable statutory rights you may have as a consumer under the Consumer Protection Act, 2019.


 

14. Limitation of liability

To the maximum extent permitted by law, in no event shall Aurea Gold and Diamonds LLP, its partners, employees, agents, suppliers, or service providers be liable for:

• Any indirect, incidental, special, consequential, punitive, or exemplary damages — including loss of profits, revenue, data, business opportunity, or goodwill — arising from your use of the Site or any product
• Any damages exceeding the total amount you paid for the specific order giving rise to the claim
• Any loss or damage caused by events beyond our reasonable control (see Section 16, Force Majeure)

This limitation applies whether the claim is based on contract, tort (including negligence), strict liability, or any other legal theory, and applies even if we have been advised of the possibility of such damages.

Some jurisdictions do not permit certain limitations of liability — in those cases, our liability is limited to the maximum extent permitted by applicable law.


 

15. Indemnification

You agree to indemnify, defend, and hold harmless Aurea Gold and Diamonds LLP, its partners, employees, agents, suppliers, service providers, and affiliates from any claim, demand, liability, loss, damage, cost, or expense (including reasonable legal fees) arising out of:

• Your breach of these Terms or any policy incorporated by reference
• Your violation of any law or third-party right
• Your User Content
• Your misuse of any product purchased from us

 

16. Force majeure

Aurea Sterling shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, government action, lockdowns, war, terrorism, civil unrest, strikes, supply-chain disruptions, courier failures, internet or payment-gateway outages, or technical failures of third-party platforms (Shopify, Meta, Google, WhatsApp, etc.).

In such cases, our obligations are suspended for the duration of the event, and we will resume performance as soon as reasonably possible.


 

17. Termination

We may suspend, restrict, or terminate your access to the Site, your account, or any service at any time, without notice and without liability, if we believe in good faith that:

• You have breached these Terms
• Your conduct creates legal, security, or reputational risk for us or other users
• You have engaged in fraud, chargeback abuse, COD refusal patterns, or reseller activity
• Required by applicable law or regulatory authority

Sections that by their nature should survive termination — including Intellectual Property, User Content licence, Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution — shall continue to apply after termination.


 

18. Governing law & dispute resolution

18.1 Governing law

These Terms and any dispute arising from or related to them, the Site, or any purchase shall be governed by and construed in accordance with the laws of India.

18.2 Arbitration

Any dispute, controversy, claim, or difference of any kind arising out of or relating to these Terms, the Site, or any product or service — including any question regarding the existence, validity, or termination of these Terms — shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended from time to time).

• Seat and venue of arbitration: Surat, Gujarat, India
• Language: English
• Arbitrator: A sole arbitrator appointed mutually by both parties. If parties cannot agree within 30 days, the arbitrator shall be appointed in accordance with the Arbitration and Conciliation Act, 1996.
• Award: The arbitral award shall be final and binding on both parties.

Notwithstanding the above, Aurea Sterling reserves the right to seek interim or injunctive relief from the competent courts in Surat, Gujarat for matters relating to intellectual property, confidentiality, or urgent equitable relief.

18.3 Jurisdiction

Subject to the arbitration clause above, the courts at Surat, Gujarat, India shall have exclusive jurisdiction over any matter not subject to arbitration.

18.4 Class action waiver

To the maximum extent permitted by law, all disputes shall be resolved on an individual basis, not as part of any class, consolidated, or representative action.


 

19. Consumer rights & grievance redressal

Nothing in these Terms limits your statutory rights as a consumer under the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020.

20. General provisions

• Entire agreement: These Terms, together with our Privacy Policy and all other policies referenced (Shipping, Return & Refund, Warranty, Exchange), constitute the entire agreement between you and Aurea Sterling.
• Severability: If any provision is held invalid or unenforceable, the remaining provisions shall continue in full force.
• No waiver: Our failure to enforce any right or provision shall not constitute a waiver of that right.
• Assignment: You may not assign or transfer these Terms. We may assign them at any time, including in connection with a merger, acquisition, or sale of assets.
• Notices: Any notice to us must be sent to care@aureasterling.com. Notices to you may be sent to the email/phone you provided at registration or order placement.
• Updates: We may update these Terms from time to time. The "Last updated" date will reflect any changes. Continued use of the Site after updates constitutes acceptance of the new Terms. For material changes, we will give at least 7 days' notice.
